What to do if your Aufenthaltstitel expires before your appointment

To stay in Germany legally, you must apply for an extension of your current residence permit before it expires: to do so, follow the official procedure for your city, and save proof that you applied. If you miss the deadline, you may have to leave the country and apply for a new permit from home. Below, we cover three scenations: your permit (1) has already expired and you have an appoitment, (2) has already expired and you don't have an appoitment or (3) expires soon.

Application date: Why it matters the most

If the immigration office receives your application before your current permit ends, you can usually keep living in Germany under the same rules while you wait for a decision.

This protection comes from Section 81(4) of the German Residence Act (Aufenthaltsgesetz), known in German as the Fortgeltungsfiktion or fiction clause. In everyday terms, your old permit continues to “cover” you during the waiting period.

You can usually keep:

• living in Germany;

• working under the same conditions;

• studying;

• freelancing;

• do everything else that your permit allows (but travelling is tricky, we'll cover it later on)

Basically, your old stay permit rights remain, but you can’t get any new ones. For example, if your permit only allows you to work for one employer, you won’t be able to change jobs while you wait for a new permit.

Scenario 1: My residence permit will expire soon, but I don’t have an appointment

Don’t wait for an open appointment slot, submit your application as soon as possible. Use the official procedure that your city offers. For instance:

• an online portal (like Residence Permit Hamburg or LEA Berlin);
• an official contact form;
• an email address provided by the immigration office;
• a postal application.

Make it clear that you are applying for your residence permit renewal, not for issuance.

Keep proof that you applied

Save the confirmation email, PDF, screenshot, sent message or postal tracking details.

The proof doesn’t guarantee your legal status, but it shows that you submitted your application before the deadline.

Keep copies of:

• your application;
• your confirmation email;
• uploaded documents;
• screenshots of the submission;
• any reference or case number.

Don’t submit the same application again

Sending duplicate applications or status requests may only confuse the system, slow down the process, and increase the processing time. Don't panic and stay patient. However, contact the office again if:

• you received no confirmation;
• the office asks for more documents;
• your address, passport or employer changes;
• you urgently need proof of your status;
• you need to travel.

If the situation is urgent, check whether your local office offers an emergency appointment.

Scenario 2: My permit has expired, but I have a future appointment

Check whether you submitted your application before your permit expired. In many cities, you apply first and receive an appointment later, so the application date is what matters.

If you only booked an appointment and didn’t send an application, check the rules of your local immigration office. In Berlin, an appointment request or contact form may sometimes be enough, but this is not the rule everywhere.

Keep your expired residence card, application confirmation and appointment email. These documents may help prove that your case is being processed and that you can stay and work. However, travelling gets tricky here, and we’ll cover it later.

Make sure you attend your appointment. If you can’t go, contact the immigration office.

Scenario 3: My permit has already expired, and I didn’t apply in time

If your permit has already expired, apply as soon as possible and contact the immigration office. Your old permit doesn’t stay valid, but the office may still allow it to continue while they review your case.

Explain why you applied late

Add a short explanation and any proof you have. This could include screenshots of earlier messages, proof of technical problems, medical documents, or copies of cancelled appointments.

Ask the immigration office to confirm in writing:

• whether you can stay in Germany;
• whether you can continue working;
• whether you can get a Fiktionsbescheinigung (check what it is in the next section).

If your application is refused or you receive a letter asking you to leave Germany, check the deadline carefully and get legal advice.

After you submit the application: What happens

Once your application is in, the immigration office will review your case. They may send a confirmation, ask for additional documents or invite you to an appointment. Sometimes, there is no update for several weeks.

A long pause does not always mean something went wrong. Check your email and spam folder regularly, and make sure your contact details are still correct.

If the office asks for more information, send it by the deadline in their message. Even one missing document can slow down your application.

Fiktionsbescheinigung: What it is and why you may need it

A Fiktionsbescheinigung is an official temporary document showing your legal status while your residence permit application is being processed. In English, it may be described as a fictitious status certificate.

In your document, you may notice one of the two sections of the law (81(4) or 81(3)). Check which one is written, as your rights depend on it.

Think of the Fiktionsbescheinigung as a temporary bridge between your old permit and the final decision. The section written on it shows how strong that bridge is: Section 81(4) usually keeps more of your previous rights than Section 81(3).

Fiktionsbescheinigung under Section 81(4)

81(4) type means that your previous residence permit and its conditions continue.

You may receive it if:

• you had a valid residence permit or national D visa;
• you applied for an extension or another permit before it expired.

You can continue working, studying or freelancing the same as before.

It also usually allows you to leave Germany and return, as long as your passport and all other documents are still valid. This type of fictitious status certificate is based on the Aufenthaltsgesetz (German Residence Act).

Fiktionsbescheinigung under Section 81(3)

81(3) type may allow you to stay in Germany while your first residence permit application is being processed. However, it usually doesn’t allow you to leave Germany and return. Your right to work may also be limited.

Can I travel with a Fiktionsbescheinigung?

You can travel and return to Germany with a valid Fiktionsbescheinigung under Section 81(4). Before travelling, check that:

• Section 81(4) is marked;
• your passport is valid;
• the certificate will still be valid when you return;
• you have your expired residence card;
• you have any supplementary sheet linked to your permit;
• the airline accepts the document;
• any transit country accepts your documents.

Carry the original documents, not only scans or photos.

Take:

• your valid passport;
• your original Fiktionsbescheinigung;
• your expired residence card;
• your supplementary sheet, if you have one.

A direct flight back to Germany may make the journey easier, as you won’t need to pass through another country.

Check with the airline before travelling to make sure they accept your documents.

How can I get a Fiktionsbescheinigung?

Request it from your local immigration office and explain why you need it. The exact process depends on your city, you may be able to  request it from Ausländerbehörde:

• during your online application;
• through a contact form;
• by email;
• during an in-person appointment.

Some offices require you to attend in person.

Explain why it’s necessary

Give a clear reason, for example, that your current card will expire before your appointment or your employer needs official proof. For travel, include flight bookings, an employer letter, medical evidence or proof of a family emergency.

To get Fiktionsbescheinigung, you may need to pay a fee – around 13 EUR for adults and 6.50 EUR for children in 2026. However, check the fee listed by your local immigration office, as it may be slightly different.

A simple timeline before your permit expires

The safest option is to start preparing several weeks before the expiry date. You don’t always need to send the application months in advance, but you should know where to apply and which documents you will need.

A simple plan may look like this:

• 8–12 weeks before expiry: check the rules of your local Ausländerbehörde;
• 6–8 weeks before expiry: collect your documents;
• when applications open: submit your request;
• after submission: save all confirmations and reference numbers;
• before travelling: check whether you need a Fiktionsbescheinigung.

The exact timeline depends on your city and permit type. Some offices accept applications months in advance, while others only open the process closer to the expiry date.
